Compliance requirements
The bidder must confirm that neither it nor the members of its management, governing or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour or other forms of human trafficking, or any other exclusion grounds listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. For subcontractors, first-tier subcontractors are checked during contract performance and must also submit an ESPD.
Qualification criteria and exclusion grounds
The bidder’s total net turnover for each of the last three completed financial years must be at least EUR 300,000 per year. To prove this, the bidder must provide turnover data in the ESPD and, if necessary, the last three annual accounts, extracts from them, or other appropriate evidence if the data are not available from a public database. Within the 36 months preceding the start of the procurement, the bidder must have properly performed at least 2 similar contracts. Similar contracts are contracts for the design, installation works and rental/lease of modular buildings or building parts made of modules, each with a closed net floor area of at least 500 m2. For the construction works, the bidder must involve a project manager who is at least a certified civil engineer level 7 or equivalent, and an architect who is at least a certified architect level 7 or equivalent. The bidder or its subcontractor must hold a business activity notice in the MTR for construction activities, or an equivalent registration or licence under the law of the country of establishment; if the bidder or subcontractor is not established in Estonia, a certificate from the competent authority confirming the registration or licence must be submitted. If the bidder relies on a subcontractor, it must show that that person will perform the relevant part of the contract itself. The bid must comply with the tender documents, conditional bids are not allowed, and the bid price must be submitted in the required structure with two decimal places and must not be zero or negative. In the case of a joint bid, an authorised representative must be appointed and a power of attorney from the joint bidders must be attached.
