Compliance requirements

The bidder must not be subject to mandatory exclusion grounds: participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing; enabling work for a foreign national staying in the country illegally or violating wage requirements; illegal use of child labour or human trafficking; tax, fee or environmental charge arrears, or social security contribution arrears in the bidder’s country of establishment. The contracting authority may also exclude a bidder that has seriously or repeatedly breached a previous public contract, or that has provided false information about qualification or failed to submit required information and documents. The bidder must confirm that none of these grounds apply.

Qualification criteria and exclusion grounds

The bidder must have, within the 60 months before the publication of the contract notice, completed at least three electrical construction contracts for a grid operator, and the total value of the reference contracts must be at least EUR 160,000 excluding VAT. A list of the main contracts must be submitted with information on value, signing dates, other contracting parties and, where available, the public procurement register reference number. On request, the bidder must provide evidence of proper performance of the contracts. The bid must include the completed price quotation table in Form 1. The bidder must have a person managing electrical works with a valid A-competence certificate or at least level 6 qualification under the Professional Qualifications Act, and that person must be added to the Elektrilevi partner portal before bid opening; the certificate may also be submitted with the bid. The bidder must also have a person appointed as responsible for operational work, entered into the EPP environment before bid opening. For preparing the building design, the bidder must have a certified civil engineer, level 7, with a valid qualification, or a general construction designer with at least level 7 qualification, and valid supporting documentation must be provided. The bidder must confirm whether subcontracting will be used in contract performance and, if so, provide subcontractor details. The bidder must provide the name, job title and contact details of the contract signatory, and where necessary a power of attorney. The bidder must confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus, and that materials, equipment and goods used in the works are not produced in or originating from Russia or Belarus; the contracting authority may request certificates of origin. The bidder must also confirm whether it chooses the contracting authority’s standard payment term or the 95-calendar-day payment term under the factoring programme.
