Compliance requirements
The bidder must confirm that neither it nor its management, representative or supervisory body members have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, money laundering or terrorist financing, child labour or other forms of human trafficking. If any exclusion ground applies, the bidder may submit evidence of self-cleaning measures, where permitted. For subcontractors, a tender passport must be submitted during contract performance, and first-tier subcontractors are checked; the same basic exclusion grounds apply to them.
Qualification criteria and exclusion grounds
Within the 60 months preceding the start of the procurement, the bidder must have properly completed at least two construction contracts for publicly used sports and leisure facilities, including playgrounds or dog exercise areas, with a total area of at least 1,800 m2. A list of those contracts must be submitted, including the national building register code, value, dates and the client’s contact details. The works must involve a project manager who has at least level 6 construction engineer or level 6 road engineer qualification, or equivalent, and who has managed at least two similar landscape construction projects in the last five years, each worth at least EUR 75,000 excluding VAT. The bid must include the project manager’s CV in the form set out in Annex 5 and, if needed, the person’s consent to participate in contract performance. The person responsible for the quality of landscape architecture works must have at least a level 4 landscape builder certificate or an equivalent EQF/ECVET level, and the tender passport must include details of their education and professional qualification. The bid must be prepared in Estonian, submitted electronically through eRHR, and include all required documents and confirmations. The bidder or its subcontractor must hold a business activity notice or an equivalent registration/licence for the activity area “Construction” with the specific classification “general construction” or “road”; if the bidder is not established in Estonia, a certificate from the competent authority of the country of establishment must be provided.
