Compliance requirements
The machine-readable notice did not include exclusion grounds; these must be checked in the tender documents. Under the compliance conditions, the bidder must confirm that it will not use subcontractors or suppliers for more than 10% of the contract value if they are citizens, residents or entities established in the Russian Federation, or if they are more than 50% owned by such persons or entities, or act under their instructions. If the bid is submitted by a group of joint bidders, an authorised representative must be appointed and a joint-bid power of attorney must be attached. The bidder must also indicate trade secrets, but may not classify the bid price or other numerical indicators that correspond to the award criteria as trade secrets.
Qualification criteria and exclusion grounds
The bidder must have carried out at least one similar construction or repair contract as the main contractor within the 36 months preceding the start of the procurement. For part 1, the experience must cover the installation, repair or reconstruction of heating systems or ground-source heat pumps. For part 2, the experience must cover the construction, reconstruction or repair of terraces. The bidder must provide the contract details: subject of the contract, value, performance period, and the contracting partner’s name, email and phone number, or the procurement reference number if it was a public procurement. The contracting authority may request confirmation from the client that the contract was performed properly. The bidder must be registered in the business register for the activity area “Construction” and must have the right to carry out heating system construction works. For bidders registered in Estonia, compliance is checked by the contracting authority on the basis of the business register data; a foreign bidder must submit proof that it is authorised to carry out the same activity in its country of establishment. The bid must be submitted in the structure required in the tender documents, and the bidder must confirm that the bid complies with the procurement documents and that it has visited the site in person and signed the site-visit sheet. If the bid is submitted by a person who is not a board member listed in the commercial register as having the right to represent the legal entity, a power of attorney must be provided.
