Compliance requirements

Mandatory exclusion grounds: the bidder and its management, supervisory or representative persons must not have been convicted of participation in a criminal organisation, corruption, fraud, terrorism, money laundering, enabling illegal employment of a foreign national, or offences related to child labour or human trafficking. The bidder must also not have tax, duty or environmental charge arrears, or tax or social security contribution arrears under the law of its country of establishment. Voluntary exclusion grounds: the contracting authority may exclude a bidder that has previously materially or repeatedly breached essential contract terms, or that has provided false information about qualification or failed to submit required data and documents. The bidder must confirm that none of these grounds apply.

Qualification criteria and exclusion grounds

The bidder must have, within the 60 months preceding the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, at least one of which must have a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, details of the other contracting party, including the client representative’s contact details, and reference numbers for public procurement contracts. The contracting authority may request evidence of proper performance. The tender must comply with all conditions set out in the procurement documents, and the tender price must be submitted in the required table with all unit price fields completed. The team must include a person with valid switching authorisations who has been entered into Elektrilevi’s partner portal before the deadline for submitting tenders. There must also be a person designated as responsible for work operations, entered into the partner portal before the deadline. In addition, the team must include a lead electrical works person with valid A-level competence or, within the meaning of the Occupational Qualifications Act, at least level 6 qualification, who holds the relevant certificate at the time of submission and has been added to the partner portal before the deadline. The bidder must provide the names and contact details of the contract signatory(ies) and the contact person, and, where necessary, a power of attorney. In the case of a joint tender, an authorised representative must be named and the joint bidders’ power of attorney must be attached. The bidder must also confirm that it is not established in the Russian Federation or Belarus and that the materials, equipment and goods used in the works are not produced in or originating from the Russian Federation or Belarus.
