Compliance requirements
The exclusion grounds include at least participation in a criminal organisation, corruption, fraud and the other mandatory exclusion grounds listed in the ESPD. The bidder, its management body members, persons with signing authority and other named persons must confirm that no relevant final convictions or exclusion obligations apply to them. If an exclusion ground exists, the bidder may submit evidence of self-cleaning measures where permitted. The machine-readable notice did not contain the full list of exclusion grounds; the rest must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must have completed, or be performing, at least one winter road maintenance, including snow-clearing, contract within the last 36 months. With the tender or upon request by the contracting authority, the bidder must provide a list of such contracts with their period of performance, value and the other contracting parties. The bidder must have, or be able to use, the snow-clearing equipment required for the relevant area, including replacement equipment; the equipment details must show the make, national registration number and basis of use. The tender must be signed by a legal or authorised representative, and a power of attorney must be provided if the signatory is not a board member entered in the register. In a joint tender, an authorised representative must be appointed and the joint bidders’ power of attorney must be attached. The tender price must be submitted as a final price including all costs of contract performance. A description of the quality assurance measures for maintenance work must also be submitted, and the bidder must confirm that it does not use a subcontractor who would have to be replaced under Section 122(7) of the Public Procurement Act.
