Compliance requirements
The bidder must confirm that neither it nor its management bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud and the other exclusion grounds listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning, where permitted. It must also confirm that, in performing the contract, it will not use subcontractors or suppliers linked to the Russian Federation and covered by the sanctions restriction for more than 10% of the contract value, and that it will not use a subcontractor subject to replacement under § 122(7) of the Public Procurement Act. In the case of a joint bid, an authorised representative must be appointed. Trade secrets must be identified and justified in the bid. Conditional bids are not allowed, and the bidder must confirm that the bid complies with the procurement documents.
Qualification criteria and exclusion grounds
The bidder must have performed at least one contract for similar design work within the last 60 months. Similar work means the design or reconstruction design of a hospital, a prison hospital or an outpatient care building, with a scope of at least 10,000 m² of enclosed net floor area and completed at least at the preliminary design stage, including the architectural part, structural part, building services systems, automation and energy efficiency. The completion of the reference must be provable by a client confirmation, contract or other document signed or accepted by the client. To perform the contract, the bidder must involve a project manager with at least level 7 authorised architect qualification or equivalent, at least 5 years of design experience, and experience managing similar design work for at least one public building with more than 5,000 m² of enclosed net floor area. In addition, the bidder must involve a responsible specialist for the high-voltage electrical field with a valid B-competence certificate or level 7 certified electrical engineer qualification or equivalent, a fire alarm systems specialist with level 6 security systems designer qualification in fire alarm system design or equivalent, and a heating, ventilation and cooling specialist whose qualification must meet the requirements set out in the procurement documents. The bidder must provide the names and details of these persons so that compliance with the qualification requirements is demonstrated. The bid must comply with the procurement documents, and equivalence must be explained and supported by evidence where necessary.
