Compliance requirements
The tender documents include the standard exclusion grounds under Estonian procurement law, including criminal organisation participation, corruption, fraud and other mandatory exclusion grounds. If an exclusion ground applies, the bidder may be allowed to provide evidence of self-cleaning where the law or the tender documents allow it. The machine-readable notice did not provide a complete plain-language list of all exclusion grounds, so they must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder must submit the forms and evidence required by the tender documents: the completed participation application, the completed technical description and bid form, technical information material, and the packaging label for each offered product. For medical devices, the manufacturer’s declaration of conformity and, where applicable, the EC certificate must also be provided.
The bid price must be submitted in the required structure, and the total price for the lot must be given without VAT according to form “312851 Annex 1 product list and unit prices”. If the price form and the worksheet differ, the contracting authority will rely on the worksheet data.
The bidder must confirm that the bid complies with the tender documents, that conditional bids are not allowed, and that any equivalence has been explained and supported by evidence.
In the case of a joint bid, an authorised representative must be appointed and a power of attorney from the joint bidders must be attached. The bidder must also identify any trade secrets, justify why the information is treated as a trade secret, and confirm that the bid does not contain prohibited trade-secret information.
The bidder must confirm that it will not use subcontractors or suppliers for more than 10% of the contract value if they are linked to the Russian Federation in the manner described in the sanctions rule. The offered goods must also not be subject to international sanctions and must not originate from sanctioned territories.
