Compliance requirements

The bidder must be excluded if a mandatory exclusion ground applies, for example conviction for participation in a criminal organisation, corruption, fraud, terrorism, money laundering or terrorist financing; enabling illegal employment or violating the conditions for employing a foreign national; offences related to child labour or human trafficking; tax, fee or environmental charge arrears; or being subject to an international sanction. The contracting authority may also exclude a bidder that has seriously or repeatedly breached a previous public contract or has submitted false information about qualification or failed to provide the required data and documents.

Qualification criteria and exclusion grounds

The bidder’s net turnover for each of the last three completed financial years must be at least EUR 1,100,000. The bidder must provide an extract from the financial statements for the last three completed financial years, or another proof available to the contracting authority, showing compliance with the turnover requirement; if the financial year does not coincide with the calendar year, the requirement applies to the last three completed financial years. At least 6 months must have passed since the end of the last completed financial year by the deadline for submitting tenders. Within the 60 months preceding the start of the procurement, the bidder must have properly performed at least 3 similar electrical construction contracts, at least one of which must have had a value of at least EUR 500,000 excluding VAT. A list of contracts must be submitted, including the performance period, details of the other contracting parties (including the client representative’s contact details) and public procurement reference numbers, where available. The contracting authority may request evidence of proper performance. The bidder must have an electrical works manager with a valid A qualification or at least level 6 qualification under the Vocational Qualifications Act, and this person must be entered in the EPP environment before the opening of tenders. The bidder must also have a person with valid rights appointed as the person responsible for the work operation, and this person must be registered in EPP before opening. The tender must include Form 1 price quotation table, Form 1.1 reserve equipment price table, and Forms 5.1 and 5.2 for the medium-voltage switchgear questionnaires. The required fields must be completed; partial completion may lead to rejection of the tender. If the bidder offers both SF6 and SF6-free equipment, separate tenders must be submitted. If SF6-free equipment from two or more manufacturers is included in the submitted tenders, only tenders containing SF6-free equipment will be evaluated. The bidder must provide the names and contact details of the contract signatory(ies) and the contact person for contract performance matters, and must include a power of attorney if the authority to sign does not arise from the articles of association. If subcontracting is used, Form 3 must be submitted. The bidder must confirm that it accepts the contracting authority’s standard payment term, that its place of residence or establishment is not in Russia or Belarus, that the materials, equipment and goods used are not produced in or originating from Russia or Belarus, and that it is ready to use Elektrilevi’s Partner Portal (EPP).
