Compliance requirements
The bidder must be excluded if any mandatory exclusion ground applies, for example a conviction for offences related to participation in a criminal organisation, corruption, fraud, money laundering, terrorism, trafficking in human beings or illegal use of child labour; tax or social security debt; being subject to international sanctions; or any other ground stated in the tender documents. The contracting authority may also exclude a bidder on optional grounds, for example for breaches of environmental, social or labour law, bankruptcy or liquidation, serious professional misconduct, anti-competitive agreements, conflicts of interest, serious prior contract breaches, false information, or tax offences. The bidder must confirm that none of these grounds apply.
Qualification criteria and exclusion grounds
The bidder’s net turnover for each of the last three completed financial years must be at least EUR 150,000. If the financial year does not coincide with the calendar year, the requirement applies to the last three completed financial years, and at least 6 months must have passed since the end of the latest completed financial year by the time the tender is submitted. The bidder must provide an extract from the annual accounts or other required evidence if the data are not publicly available to the contracting authority from official registers. To prove technical capability, the bidder must have properly performed at least 3 similar electrical construction contracts within the 60 months before the start of the procurement, at least one of which had a value of at least EUR 80,000 excluding VAT. A list of the contracts must be submitted, including performance periods, client contact details and public procurement reference numbers, and the contracting authority may request evidence of proper performance. The tender must comply with the tender documents and include the completed price table. Before tenders are opened, the bidder must have in the EPP environment a person with valid switching authorisations, a person responsible for the work operation, and a person managing electrical works with valid A-competence or at least level 6 qualification. The bidder must also provide the contract signatory’s and contact person’s details and, where necessary, a power of attorney. The bidder must also confirm that it chooses the contracting authority’s standard payment term unless it has joined the factoring programme.
