Compliance requirements
The tenderer must confirm that neither the tenderer nor its management, administrative or supervisory body members, persons with power of representation, or proxies have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, or any other exclusion ground listed in the tender documents. If an exclusion ground applies, the tenderer may submit evidence of self-cleaning measures where permitted. The machine-readable notice did not set out all exclusion grounds in full; the remaining grounds must be checked in the tender documents.
Qualification criteria and exclusion grounds
The tenderer must have an employee or other contractual representative for the offered products who has been trained by the manufacturer or has completed training on the products. The tenderer must provide the name of the product representative in the ESPD and, upon the contracting authority’s request, copies of certificates proving the training or a written confirmation from the manufacturer of the training. The tenderer must have the right to represent and sell the offered products in Estonia and must submit a document, or a copy of it, issued by the manufacturer or the manufacturer’s authorised representative. The offered products must bear the CE marking and be placed on the market in accordance with Regulation (EU) 2017/745 or its transitional provisions; copies of the declarations of conformity and, where required by the risk class, the relevant EC certificates must be submitted, with the offered products clearly highlighted. The tender must comply with the technical specification, and the completed Annex 1, the manufacturer’s technical description, user manuals and other Estonian- or English-language materials proving compliance must be submitted. In the case of a joint tender, a power of attorney and a confirmation of joint and several liability on the form in Annex 3, Form I, must be submitted. An application on the form in Annex 3, Form II, must also be submitted, and the tenderer must confirm that the tender complies with the procurement documents and that the offered goods are not subject to international sanctions and do not originate from sanctioned regions.
