Compliance requirements
The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members, procurists or other persons authorised to represent it have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud and the other exclusion grounds listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning, where permitted. The bidder must also confirm tax and social security payment information if required by the contracting authority or if it can be checked electronically.
Qualification criteria and exclusion grounds
The machine-readable notice did not include precise selection or suitability criteria; these must be checked in the tender documents. As compliance requirements, the tender must be submitted in accordance with the procurement documents, conditional tenders are not allowed, the tender price must be provided in the prescribed structure, and the tender must comply with all required conditions. If the offered goods or solution rely on equivalence, this must be explained where necessary and evidence of equivalence must be attached. Offers may be submitted for up to 35 lots, and a contract may also be awarded for up to 35 lots to one bidder. In addition, the bidder must confirm that the offered goods are not the object of international sanctions and do not originate from sanctioned areas, and that subcontractors or suppliers linked to the Russian Federation and exceeding 10% of the contract value are not used. In the case of a joint tender, an authorised representative must be appointed and a power of attorney from the joint bidders must be attached.
