Compliance requirements
The bidder must confirm that neither the bidder nor its management or authorised representatives have been finally convicted in the last five years for participation in a criminal organisation or for corruption. If such a ground exists, the bidder may submit evidence of self-cleaning measures where permitted. The tender documents also require a confirmation that the bidder will not use a subcontractor who would have to be replaced under Section 122(7) of the Public Procurement Act.
Qualification criteria and exclusion grounds
The bidder’s team must include a road engineer, level 6, with the professional field of construction management, and a competent responsible person with the same professional qualification must be involved in performing the contract. If the bidder relies on another company’s specialist, it must submit that company’s written confirmation and, where applicable, the natural person’s ESPD. The bidder must also have at least one properly completed major works contract within the 60 months before the start of the procurement, together with evidence that the work was performed properly. The bid must comply with the tender documents, be unconditional, and the price must be submitted in the required structure and in the separate price table. In the case of a joint bid, a power of attorney from the joint bidders must be submitted. The machine-readable notice did not include precise additional qualification or compliance requirements; these must be checked in the tender documents.
