Compliance requirements

The bidder and its management body members must not have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, or other serious offences listed in the tender notice. If such a ground exists, the bidder may submit evidence of self-cleaning measures where permitted. The notice also includes a sanctions-related prohibition: the offered goods must not be subject to international sanctions and must not originate from sanctioned regions. In addition, the bidder must confirm that its place of residence or establishment is in an allowed country.

Qualification criteria and exclusion grounds

The bidder must have prior experience in selling a forklift/loader. Sufficient experience means having sold at least one forklift similar to the subject of this procurement during the 36 calendar months preceding the publication of the tender. To prove this, the bidder must provide a list of sales contracts or other relevant references with values, dates and the other contracting party. Under the compliance requirements, the bidder must submit a completed technical compliance form, the loader product sheet and a CoC conformity certificate. The offered loader engine must comply with at least the EU Stage V emission standard. In the case of a joint tender, a power of attorney signed by all joint bidders must be submitted; if the tender is not joint, this must be confirmed separately. The bidder must also confirm that the tender complies with the procurement documents, remains valid for 3 calendar months from the submission deadline, and that equivalence has been explained and supporting evidence attached where necessary.
