Compliance requirements
The bidder must confirm that neither it nor the members of its management, administrative or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption or fraud. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The machine-readable notice did not include any more precise exclusion grounds; the remaining requirements must be checked in the procurement documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment. If requested by the contracting authority, proof of registration must be provided. The tender must be confirmed as compliant with the procurement documents, submitted in the required structure, and, where necessary, equivalence must be explained and supporting evidence attached. The offered products must have CE certification. If subcontractors are used, the subcontracted share must be indicated and, where necessary, a separate ESPD must be submitted for the subcontractors. The compliance conditions also require confirmation that subcontractors or suppliers from the Russian Federation, or entities controlled by them, are not engaged for more than 10% of the contract value. In a joint tender, a power of attorney for the joint tenderers must be submitted. The tender must include Forms 1–3. The machine-readable notice did not include any more precise qualification or compliance requirements; the remaining requirements must be checked in the procurement documents.
