Compliance requirements
The tender documents include the standard exclusion grounds, especially criminal convictions such as participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour and other forms of human trafficking, as well as other mandatory exclusion grounds under the Public Procurement Act. The bidder must confirm these matters in the tenderer’s declaration and, where applicable, may have to provide evidence of self-cleaning. The machine-readable notice did not include all precise exclusion details; they must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment. The bidder’s net turnover for the last three completed financial years must be at least EUR 150,000 in each year, and the bidder must provide turnover data for that period. For technical and professional capacity, the bidder must have, as main contractor, properly carried out public road surfacing works of at least 20,000 m2 during the 60 months before the start of the procurement, with at least 2 such works listed in the ESPD and, if requested, client confirmations showing proper performance and contract details. The bidder must have an MTR registration for road construction by the time the contract is signed. The team must include a site manager for the road works who has participated as site manager in at least three similar construction contracts, holds a diploma-level road engineer qualification at level 7 or an equivalent qualification under the law of the country of establishment, and has good Estonian language skills in speech and writing. The bidder must also submit the completed Form 1 quantity table and Form 2 site manager confirmation, and confirm that the bid is unconditional and complies with the tender documents.
