Compliance requirements

The bidder must confirm that neither the bidder nor any entity relied on for qualification has the exclusion grounds set out in section 95(1) of the Public Procurement Act. The contracting authority also checks these grounds for any such supporting entity. The contracting authority may exclude a bidder if the exclusion ground in section 95(4)(8) applies, namely previous breach of public contracts. If the bidder answers “No”, it must describe the relevant exclusion ground or contract breach and provide the contract details and circumstances. The same checks apply to any entity whose resources are relied on for qualification. The bidder must also confirm that neither the bidder nor any entity relied on for qualification is established in the Russian Federation or the Republic of Belarus.

Qualification criteria and exclusion grounds

The bidder’s net turnover for each of the last two completed financial years before the start of the procurement must have been at least EUR 250,000. If the financial year follows the calendar year, the last two completed financial years are 2025 and 2024. The bidder must have properly performed at least two similar construction contracts within the 60 months before the publication date of the contract notice. A similar contract means a contract where the bidder acted as main contractor or subcontractor, the work covered at least 100 m² of enclosed net floor area, and the works included construction or reconstruction of the building interior, interior finishing works, and installation of a new electrical system or reconstruction of an existing one. The bidder must submit the contract details on Form 1 and, if requested, a confirmation letter from the client. The bidder, or each joint bidder, must have a quality management system in the field of construction works that meets at least ISO 9001 or an equivalent document. For a qualification certificate issued in Estonia, the contracting authority checks the specialist’s qualification in the public register of the Estonian Qualifications Authority; for a certificate issued abroad, the bidder must submit the document from the competent authority and the Estonian authority’s confirmation of equivalence. Form 4 must be submitted for the project manager. The bid must comply with all requirements set out in the procurement documents. The bidder must submit Forms 2, 3 and 4 and, where applicable, evidence of equivalence.
