Compliance requirements
The contracting authority will exclude a bidder if the bidder or its management, supervisory or representation body members, proxy holders or other authorised persons have been convicted of participation in a criminal organisation, breach of integrity duties, corruption, fraud, a terrorist offence or related offences, money laundering or terrorist financing, illegal employment of a foreign national staying without legal basis, or illegal employment conditions for a foreign national in Estonia, or child labour or human trafficking. Exclusion also applies if the bidder has tax, fee or environmental charge arrears, or if awarding the contract would breach an international sanction or a sanction of the Government of the Republic of Estonia. The bidder must confirm the absence of exclusion grounds on the required form. In a joint tender, all joint bidders must submit the confirmations relevant to them.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of an EU, EEA or WTO GPA member state if required by the laws of the bidder’s country of establishment. An Estonian bidder does not need to submit a copy of the registration certificate.
If the bidder relies on the capacities of another undertaking, it must provide details of that person and also submit that person’s confirmations on form HD Annex 5.1.
The bidder’s net turnover for each of the last three completed financial years before the start of the procurement must have been at least EUR 500,000 excluding VAT in each year. If the financial year does not follow the calendar year, the bidder must provide turnover data for the relevant financial years. The contracting authority may request an extract from the annual accounts or other documents proving turnover.
Within the 60 months before the start of the procurement, the bidder must have performed 1 or 2 railway construction contracts on a public railway, with a total of at least 100 m of railway installation or major renovation and at least 1 railway turnout installation. Removal of an existing turnout for repair and its subsequent reinstallation also qualifies. The contracting authority may request a confirmation from the client about the completed works.
The bid must include the participation application on form HD Annex 2 and the bid price submission on form HD Annex 7. The bid price must be submitted in euros according to the required structure and with all relevant table fields completed. The submission form must not be altered. The bid must also comply with the tender documents, and where necessary, evidence and an explanation of equivalence must be provided.
