Compliance requirements
The bidder must confirm the standard exclusion grounds in the ESPD. The notice includes convictions-related exclusion grounds such as participation in a criminal organisation, corruption and fraud. If an exclusion ground applies, the bidder may provide evidence of self-cleaning where allowed by the procurement documents or by law.
Qualification criteria and exclusion grounds
The bidder must have valid professional liability insurance, or be ready to conclude it after being awarded the contract. The insurance must be valid for the whole contract period and cover damage caused by the bidder’s acts or omissions during performance. The insurance sum must be at least EUR 50,000 per insured event.
The bidder must prove that during the 36 months before the start of the procurement it has cleaned ventilation systems in at least 6 buildings with a closed net area of at least 1,500 m2 and at least 5 floors. For each reference, the bidder must provide at least the client’s name and contact details, a description of the contract, the building’s closed net area, number of floors, building address and the performance period; if the contract was awarded through an RHR procurement, the procurement reference number must also be provided.
The tender must be submitted by a person with representation rights or digitally signed by such a person. If representation rights do not appear from the register, a power of attorney must be attached. In a joint tender, the joint bidders must appoint a common representative, attach the joint bidders’ power of attorney and confirmation, and submit the ESPD for all joint bidders.
If the bidder relies on the resources of another company, it must prove that those resources are available, that the other company agrees to their use, and that they will be used in performing the contract. The bidder must also describe which resources are made available, how they will be used and to what extent the other company will participate in performance. For economic and financial capacity, the bidder and the other company are jointly liable for proper performance.
A bidder registered in Estonia must have submitted the economic activity notice for the activity area “Construction” with the sub-area “Indoor climate systems”. A bidder registered abroad must have an equivalent registration in its country of establishment and must provide proof of that registration and a description of its content.
Before submitting the tender, bidders must inspect the buildings and attach the completed form “Building inspection”. The bidder must take into account all visible and reasonably identifiable circumstances and may not later raise claims about them.
The tender price must be submitted in euros, excluding VAT, and must not be conditional. The required confirmations and the price table must also be submitted.
