Compliance requirements
The tender documents set out the exclusion grounds. The bidder must confirm that none of the mandatory exclusion grounds apply, including criminal convictions of the bidder or its representatives, tax or social security debts, and sanctions-related restrictions. The bidder may also be excluded for certain discretionary grounds such as serious breaches of labour, environmental or social obligations, bankruptcy or liquidation, serious professional misconduct, false information, conflicts of interest, or significant breaches of earlier contracts. If the bidder relies on another undertaking’s resources, the required no-exclusion confirmation must also be provided for that undertaking.
