Compliance requirements
The bidder is excluded if it is bankrupt or in liquidation, if bankruptcy or liquidation proceedings have been opened, if business activity is suspended, or if it is in a similar situation under the law of its country of establishment. The bidder is also excluded if it has tax, fee, environmental charge, social security or similar arrears, unless the debt has been deferred, paid, or is being paid within 10 calendar days after notice. The notice also refers to exclusion under the Public Procurement Act section 95(1) points 1–3 and 5, to the requirement that the bidder’s average wage in the reference period must not be below 70% of the sector average, and to the rule that the bidder and the technical consultant advising the apartment building reconstruction must not be related persons. If the machine-readable notice does not provide exact proof requirements, they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must have filed in the business register a notice for construction activities covering general construction, indoor climate systems, and building water supply or sewerage systems. For electrical works, the bidder must also have a notice for electrical works covering the construction, including installation, of electrical installations. Foreign bidders are not subject to the Estonian registration requirement but must prove equivalent competence if needed.
The bidder’s net turnover for the financial year preceding the submission of the tender must be at least equal to twice the estimated contract value excluding VAT. The exact amount must be entered to the nearest euro.
Within the 60 months before the start of the procurement procedure, the bidder must have completed at least one equivalent construction project with a value of at least half of the estimated contract value. An equivalent project means a main contractor project for the erection, extension or full reconstruction of a building, including at least construction or reconstruction of the load-bearing and external envelope structures, construction or reconstruction of a heat-recovery mechanical ventilation system, and construction or reconstruction of a heating system. To prove this, the bidder must provide the project name, time, value, description of the work, and either the number of the occupancy notice or occupancy permit, or a handover-acceptance report.
The bidder’s team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and, where electrical works are performed, a person with the required electrical competence. The project manager must have at least level 6 professional qualification as a civil engineer or level 6 construction manager qualification; the site manager must have at least level 5 construction foreman qualification; the ventilation and heating systems specialist must have at least level 6 qualification as a heating, ventilation and cooling engineer or level 6 construction manager qualification; the water supply and sewerage systems specialist must have at least level 6 qualification as a water supply and sewerage engineer or level 6 construction manager qualification; and the person performing electrical works must have at least a class B competence certificate or a level 6 electrical engineer qualification in consumer electrical installations. If the bidder relies on the capacities of other persons, signed confirmations from those persons allowing participation in contract performance must be attached.
