Compliance requirements

The bidder must confirm the standard exclusion grounds in the tender documents, including convictions for participation in a criminal organisation, corruption, fraud and other mandatory exclusion grounds listed in the ESPD. If an exclusion ground applies, the bidder may provide evidence of self-cleaning where allowed by the procurement documents or applicable law.

Qualification criteria and exclusion grounds

The bidder must provide a bid guarantee by bank, financial institution or insurer guarantee, or by depositing the amount into the contracting authority’s bank account. The guarantee must be EUR 7,500 for each framework agreement offered, and its validity period must match the bid validity period. The bid must be digitally signed. If the bidder is established in Estonia, it must be signed by a person with representation authority. If the bidder is established outside Estonia, the bid must include a signed confirmation by the authorised representative that, if successful, the bidder will be bound by the contract. If the bid is submitted by someone other than the legal representative, a power of attorney for submitting the bid and concluding the contract must be attached. The bidder must confirm that the bid complies with the tender documents and, where relevant, that equivalence has been explained and supporting evidence has been attached. The machine-readable notice did not include precise qualification or suitability criteria; these must be checked in the tender documents. The tender documents do state that the technical requirements are set out in Annex 11/1 to the framework agreement.
