Compliance requirements
The bidder must confirm that neither the bidder nor the members of its management, administrative or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences or offences related to terrorist activity, money laundering or terrorist financing. The bidder must also confirm that no current exclusion period applies, or that it has been remedied under the law or the tender documents. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures to restore reliability.
The machine-readable notice did not include precise exclusion grounds beyond these standard criminal and integrity grounds; they must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder must have a waste permit and a waste handling licence, or equivalent arrangements with a waste management company, for waste handling. The bidder must confirm the existence of the required waste permit and waste handling licence or a waste management contract, or provide a written agreement to obtain the necessary permit and licence or to conclude a waste management contract for performance of the contract. The contracting authority will verify the permits in the environmental permits register.
For technical and professional capacity, the bidder must have completed at least two maintenance contracts for green areas and planting areas during the 36 months before the start of the procurement, each worth at least EUR 20,000 excluding VAT. The contracts may have started before that period and may still be ongoing at the tender deadline, but at least EUR 20,000 excluding VAT must have been performed under each contract. The bidder must list the contracts in the ESPD, including their value, signing dates and the other contracting party.
The bidder, joint bidders and subcontractors directly involved in performance must have professional competence corresponding to the following qualifications: gardener level 4, junior gardener level 3, landscape builder level 3, or a diploma specialist with a qualification in landscape architecture; and arborist level 4. For work beyond the limits of their competence, the contractor must involve a person with the relevant professional qualification and perform the work under that person's guidance and responsibility. The bidder must provide the name of the competent person, the qualification and the professional certificate number in the ESPD. On request, the bidder must submit copies of the relevant professional certificates, copies of education documents and consent letters from the responsible persons to participate in performance of the contract. The contracting authority recommends submitting these documents together with the tender.
