Compliance requirements
The bidder must confirm that neither it nor the members of its management, administrative or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption or fraud. If such a ground exists, the bidder may submit evidence of self-cleaning measures. The bidder must also confirm that it will not involve subcontractors or suppliers representing more than 10% of the contract value who are citizens, residents or undertakings established in the Russian Federation, entities more than 50% owned by them, or their representatives or persons acting on their instructions. In addition, the bidder must confirm that it will not use a subcontractor that would have to be replaced under Section 122(7) of the Estonian Public Procurement Act.
Qualification criteria and exclusion grounds
The bidder must be entered in the commercial register of its country of establishment. For service contracts, the bidder must also have any special licence required to provide the service in its country of activity, if such a licence is required by law. For waste-sector activities, registration in the KOTKAS environmental decisions information system is required. The bidder must have continuous professional liability insurance during the contract period with a minimum cover of EUR 5,000 per calendar year, and the insurer must pay compensation directly to the contracting authority if a loss event occurs. The bidder must also have at least 1 completed contract for sanitary cleaning services performed during the last 3 calendar years, with information on the contract object, value, dates, the other contracting party and, for public contracts, the relevant procurement reference number. The machine-readable notice did not include any more precise qualification or compliance requirements; these must be checked in the tender documents.
