Compliance requirements
The tender documents include the usual mandatory exclusion grounds, especially criminal convictions such as participation in a criminal organisation, corruption and fraud. The bidder must answer the exclusion questions and, where relevant, provide the conviction date, reason, person concerned, exclusion period, self-cleaning measures and electronic evidence details. Qualification criteria and exclusion grounds
The machine-readable notice did not include precise qualification or suitability criteria; these must be checked in the tender documents. The ESPD does, however, set out exclusion grounds and bid compliance requirements. The bidder must confirm that, in performing the contract, it will not use subcontractors or suppliers accounting for more than 10% of the contract value if they are Russian citizens, residents or companies established in the Russian Federation, or if they are more than 50% owned by such persons or entities, or act on their instructions. The bidder must also confirm that the bid complies with the tender documents, that the offered goods are not subject to international sanctions and do not originate from sanctioned areas, and that any equivalence has been explained and supporting evidence attached.
