Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members, procurators or other authorised representatives have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering, child labour or any other exclusion ground listed in the ESPD. If any ground applies, the bidder must provide details of the conviction and, where relevant, an explanation of self-cleaning measures taken to restore reliability. The ESPD also includes a confirmation regarding payment of taxes and social security contributions.
Qualification criteria and exclusion grounds
The tender must comply with the procurement documents and conditional tenders are not allowed. The bidder must submit the completed tender form, technical information material and, for medical devices, the instructions for use, the manufacturer’s declaration of conformity and, where applicable, the EC certificate. The tender price must be provided in the required structure, and if the price form and the evaluation sheet differ, the contracting authority will rely on the price form. If the bidder relies on equivalence, it must explain this where necessary and attach supporting evidence. The bidder must also confirm that the tender complies with all conditions set out in the procurement documents. If the bidder wants to receive 2 extra points for a climate and environmental impact reduction target, it must have a publicly accessible web link showing such a target. In the case of a joint tender, a power of attorney from the joint bidders must be attached. The machine-readable notice did not include precise qualification requirements; these must be checked in the tender documents.
