Compliance requirements
The bidder must confirm that neither the bidder nor members of its management, administrative or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, or any other exclusion ground listed in the ESPD. If an exclusion ground exists, the bidder may in certain cases submit evidence of self-cleaning measures to restore reliability.
The bidder must also confirm that it has not committed any corrupt acts in the course of this procurement procedure. In addition, subcontractors or suppliers representing more than 10% of the contract value may not be used if they are linked to the Russian Federation in the manner described in the sanctions rules. Economic operators whose place of residence or establishment is in the Russian Federation or the Republic of Belarus are not allowed to participate. The bidder must confirm that the offered goods are not the object of international sanctions and do not originate from sanctioned areas. If the exact requirements are not stated in the machine-readable notice, they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder’s net turnover for each of the last three completed financial years must be at least EUR 150,000 for each lot for which a bid is submitted. If the bid is submitted for both lots, the total turnover must be at least EUR 300,000 for each financial year. The bidder must provide turnover figures for the last three completed financial years and, if requested, an extract from the annual accounts or another proof of turnover. An Estonian legal entity does not have to submit documents that are available to the contracting authority from public registers.
The bidder must have properly performed at least two sales contracts similar to the subject matter of the tender within the last 36 months. The contracts must cover equipment for public spaces together with installation, transport and other related work. Each contract must have a value of at least EUR 100,000 excluding VAT. If the goods were sold under a framework agreement, qualification may be demonstrated through contracts concluded and performed under that framework agreement.
The bid must comply with the procurement documents, including the technical specification and the price form in Annex 2. The bidder must confirm that the offered goods are new and meet all technical and functional requirements. If equivalent solutions are used, this must be clearly explained and evidence of equivalence must be attached.
