Compliance requirements
The bidder is excluded if it is bankrupt, in liquidation, subject to bankruptcy or liquidation proceedings, or otherwise suspended in a similar situation under the law of its country of establishment. The bidder is also excluded if it has unpaid national tax, fee or environmental charge debts, or tax or social security contribution debts under the law of its country of establishment, unless the debt has been deferred, paid, or is being paid/deferred within 10 calendar days after notice.
The bidder must also confirm that the exclusion grounds under section 95(1)(1–3 and 5) of the Estonian Public Procurement Act do not apply, taking into account section 95(2). If the contracting authority cannot verify the absence of exclusion grounds from public registers, it may request supporting evidence issued no more than two weeks before the tender deadline. The bidder must also confirm that it is not a related person to the technical consultant advising the apartment building reconstruction.
Qualification criteria and exclusion grounds
The bidder must be registered for construction activities covering general construction, indoor climate systems, and building internal or adjacent water supply or sewerage systems. For electrical works, the bidder must also have a registration for electrical works covering the construction, including installation, of electrical installations. The registration requirement does not apply to foreign bidders, but they must prove equivalent competence.
The bidder’s net turnover for the financial year preceding the submission of the tender must be at least equal to twice the estimated value of the contract, excluding VAT. The exact amount must be entered to the nearest 1 euro.
The bidder must provide a construction-period security: a first-demand guarantee issued by a credit or financial institution or an insurance company in the amount of 5% of the contract price excluding VAT. The security must be available by the date of contract signature at the latest, or within 10 calendar days after signature if the contract is signed before the security is provided. A deposit of the corresponding amount into the contracting authority’s bank account or a notary account is also acceptable, provided the beneficiary remains the contracting authority throughout the construction period.
The bidder must prove that within the 60 months before the start of the procurement procedure it has carried out at least one equivalent construction project with a value of at least half of the estimated contract value. An equivalent project means the main contractor role in the construction, extension or full-scale reconstruction of a building, including at least construction or reconstruction of the load-bearing and external envelope structures, construction or reconstruction of a heat-recovery mechanical ventilation system, and construction or reconstruction of a heating system. To prove this, the bidder must provide the project name, building details, time and value of performance, whether the project met the required scope, and either the use notice/use permit number or a copy of the handover-acceptance certificate signed by the client and contractor.
The bidder’s team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and, for electrical works, a suitably qualified person. The project manager must have at least level 6 civil engineer qualification or level 6 construction manager qualification; the site manager at least level 5 construction foreman qualification; the ventilation and heating systems specialist at least level 6 heating, ventilation and cooling engineer qualification or level 6 construction manager qualification with specialization in indoor climate systems; the water supply and sewerage systems specialist at least level 6 water supply and sewerage engineer qualification or level 6 construction manager qualification; and for electrical works at least a B-class competence certificate or level 6 electrical engineer qualification for consumer electrical installations.
