Compliance requirements
The bidder must confirm that none of the exclusion grounds under Section 95(1)(1)–(5) of the Public Procurement Act apply to it. These include, among other things, convictions for participation in a criminal organisation, corruption, fraud, terrorism, money laundering, illegal employment of foreign workers, human trafficking, tax debts, or a situation where concluding the contract would violate an international sanction or a sanction of the Government of the Republic. If the bidder cannot confirm this, it may be excluded from the procurement procedure.
Qualification criteria and exclusion grounds
The bidder must be entered in the commercial register of its country of establishment, if this is required by the law of that country, and must provide evidence of registration where such an obligation exists. To demonstrate technical and professional capability, the bidder or its subcontractor must have performed at least one similar contract during the 36 months preceding the start of the procurement. A similar contract means either a contract under which at least 500 remote-reading modules or meters with remote-reading modules were sold, or a contract under which remote-reading communication services for meter data were provided to at least 500 devices for at least 12 months. The bidder must submit a list of these contracts with their value, dates and the other contracting parties. If the bidder relies on the resources of another company or a joint bidder, it must also provide that party’s details and, if requested, that party’s consent and confirmation of participation. The bid must also include the forms for the general data integration requirements and the general platform requirements, and the bidder must confirm that the offered solution complies with the requirements in the tender documents or that equivalence has been explained and supporting evidence has been attached.
