Compliance requirements
The bidder must confirm that neither it nor the members of its management, governing or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud or any other exclusion ground listed in the tender documents. If an exclusion ground applies, evidence of self-cleaning measures must be provided where permitted. The ESPD may also require details of authorised persons, if applicable. The machine-readable notice did not include precise exclusion grounds beyond the standard grounds; they must be checked in the official tender documents or tender documents and the ESPD form. The bidder must also confirm the sanctions-related subcontractor and supplier restrictions set out in the compliance conditions, where applicable to the lot concerned, and that the offered goods are not subject to international sanctions and do not originate from sanctioned regions. The bidder must confirm that any subcontractors and suppliers used for performance are established in the permitted countries and that the equipment bears an EU-recognised CE mark or an equivalent mark where required by the tender documents.
