The bidder is excluded if any of the exclusion grounds under Section 95(1) of the Estonian Public Procurement Act apply to the bidder or its authorised representatives. This includes convictions for participation in a criminal organisation, corruption, fraud, terrorism, money laundering, financing of terrorism, illegal use of child labour or human trafficking, as well as enabling illegal employment of a foreign national or violating wage requirements. Exclusion also applies if there are outstanding state tax, fee or environmental charge debts, or tax or social security contribution debts in the bidder’s country of establishment, or if concluding the contract would breach an international sanction or a sanction of the Government of the Republic. If the bid is submitted together with a foreign company, documents proving the absence of exclusion grounds for that company and its management and representation persons must be submitted with the bid if the contracting authority cannot verify them from public registers. The bidder must also confirm that subcontractors and suppliers accounting for more than 10% of the contract value are not Russian citizens, residents or companies established in the Russian Federation, entities more than 50% owned by such persons or entities, or representatives of such persons or entities acting on their instructions. If this sanctions requirement is not met, the bid may be rejected.

The bidder’s net turnover for the last three completed financial years before the start of the procurement must total at least EUR 1,500,000, and each of those years must be at least EUR 500,000. If the bidder is not a legal entity registered in Estonia, or if the contracting authority cannot verify the data from public sources, annual report extracts or other evidence must be provided on request. Joint bidders may rely on each other’s figures. The bidder must submit at least one reference for a mobile LNG vaporiser. The reference unit must have been manufactured or supplied within the last 36 months before the publication of the contract notice, must have at least 75 MW capacity, and must be transportable by a semi-trailer used for ordinary road transport. For each reference, the bidder must provide a general description of the unit, the client’s name and destination country, technical data including dimensions and mass, the delivery date, and proof of successful completion, such as photos or other visual documentation. The contracting authority may request additional evidence and contact the client. The bid must include a technical description of the offered unit(s), including the manufacturer’s name and equipment data, a price table, bid security in the amount of EUR 10,000, preliminary spare parts lists for regular maintenance and critical spare parts for 1,000 operating hours or 4 years, and, where required, the bidder’s power of attorney, joint-bid authorisation and confirmation, and other documents required by the tender documents. The offered equipment must be new, unused, defect-free and compliant with the technical requirements. The bidder must confirm that it has the necessary intellectual property and personal data processing rights and that it has reviewed all conditions.
