Compliance requirements

The bidder must confirm that neither it nor its management, administrative or supervisory body members, procurists or other authorised representatives have been finally convicted within the last five years for participation in a criminal organisation, corruption or fraud. If such a ground exists, the bidder may submit evidence of self-cleaning measures where permitted. The machine-readable notice also contained other standard exclusion grounds, but the exact list must be checked in the tender documents. The tender documents must also be checked for any additional confirmations required from the bidder regarding sanctions and subcontractors, if applicable, because the precise wording was not fully available in the machine-readable notice.

Qualification criteria and exclusion grounds

The bidder must have a total annual turnover of at least EUR 350,000 in the latest financial year ended before the start of the procurement. Joint bidders may combine their figures. The bidder must provide the turnover data in the ESPD and, if requested, an extract from the latest annual report or other documents proving the turnover amount. For technical and professional capacity, the bidder must have performed software development contract(s) during the 36 months before the start of the procurement with a total value of at least EUR 300,000 excluding VAT. At least 1 completed contract is required. If relying on another entity’s resources, the bidder must identify that entity in the ESPD and, if requested, submit the other entity’s consent and supporting documents. The bidder must also submit a project plan with the tender, based on Annex 4 to the technical description, covering at least the work stages and their description, sequence and dependencies, methodology and work organisation, resource use and roles, risk analysis and mitigation measures, communication and cooperation arrangements, handling of integrations and dependencies, and deployment and transition arrangements. The bidder must have a minimum team of 6 members available for contract performance, and the key persons must be able to work with the contracting authority in Estonian and with technical and functional specifications prepared by third parties in Estonian and English. The team must meet the requirements set out in the tender documents for the contractor’s team. The tender documents also require the bidder to confirm acceptance of all tender conditions, to submit a tender only for the matters requested by the contracting authority, and not to use a subcontractor that would have to be replaced under the Public Procurement Act.
