Compliance requirements
The bidder must confirm that neither it nor the members of its management body have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud or any other exclusion ground listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures, where permitted. The ESPD also asks for confirmation that taxes and social security contributions have been paid and whether the relevant information is electronically available.
Qualification criteria and exclusion grounds
The tender must comply with all conditions set out in the procurement documents and annexes, and conditional tenders are not allowed. The bidder must submit the completed participation application form, Annex 1 product list and unit prices, and a technical data sheet together with manufacturer documents in Estonian or English proving that the offered product complies with the requirements. The technical data sheet must allow the contracting authority to verify compliance quickly and unambiguously. If an equivalent solution is offered, it must be explained and evidence of equivalence must be attached. In the case of a joint tender, a power of attorney from the joint bidders must be submitted. The bidder must also confirm that, in performing more than 10% of the contract value, it will not use citizens, residents or companies established in the Russian Federation, or persons controlled by them, and that the offered goods are not subject to international sanctions and do not originate from sanctioned territories.
