Compliance requirements

The bidder must confirm that neither it nor members of its management, administrative or supervisory bodies have been finally convicted within the last 5 years for participation in a criminal organisation, corruption, fraud, terrorism, money laundering, child labour, human trafficking or any other exclusion ground listed in the tender documents. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The bidder must also confirm the ability to pay taxes and social security contributions and that it will not use subcontractors or suppliers accounting for more than 10% of the contract value if they are Russian citizens, residents, or entities established in the Russian Federation, or entities controlled by them. Qualification criteria and exclusion grounds

The bidder must have the manufacturer’s right to sell the subject matter of the contract and provide product support in the territory of the Republic of Estonia. To prove this, the bidder must submit a copy of the relevant document or a link to the manufacturer’s and cooperation partner’s website; if the right is proven through a cooperation partner, two proofs are required: the manufacturer’s confirmation of the cooperation partner’s sales/support authorisation and the cooperation partner’s confirmation of cooperation with the bidder. If the bidder does not provide the requested information, the contracting authority may verify the right, and evidence that existed before the tender submission deadline will also be accepted. The tender must comply with the procurement documents and, where necessary, include an explanation of equivalence and supporting evidence. The bidder must also confirm that it, any joint bidders and any possible subcontractors are established or resident in Estonia, another EU Member State, an EEA contracting state or a country that has joined the WTO Government Procurement Agreement. The tender validity period is 4 months. For the successful bidder, contract-signing details must be provided, a power of attorney is required in the case of a joint tender, and subcontractor details and trade-secret markings must be submitted.
