Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in Section 95(1) points 1–3 and 5 of the Public Procurement Act apply, that it is not bankrupt or in liquidation, that no bankruptcy or liquidation proceedings have been initiated against it, and that it has no tax debt. The bidder must also confirm that its employees’ average salary during the reference period was above 70% of the average salary in the relevant sector for the same period. In a joint tender, the exclusion grounds are checked for each joint bidder separately. The bidder must also confirm that it is not a related person to the contracting authority’s technical consultant Urmo Kaasik.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register under the activity ‘Construction’ for general building works, indoor climate systems, and internal or adjacent water supply or sewerage systems. For electrical works, the bidder must also have a registration under ‘Electrical works’ for the construction, including installation, of electrical installations; the registration requirement does not apply to foreign bidders, who may prove equivalent competence instead.
The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least twice the estimated contract value excluding VAT. In a joint tender, turnover may not be aggregated; the requirement must be met by at least one joint bidder on its own.
The bidder must have completed at least one equivalent construction project as main contractor within the last 60 months, with a value of at least half of the estimated contract value excluding VAT. An equivalent project must involve the construction, extension or full reconstruction of a building and must include at least the construction or reconstruction of load-bearing and external envelope structures, heat-recovery mechanical ventilation, and heating systems. The bidder must provide the building name, execution period and value, and evidence in the form of a handover-acceptance certificate, a building register notice, a building permit, or a reference to the relevant number.
The team must include a project manager with at least level 6 construction engineer qualification specialising in building construction or level 6 construction manager qualification specialising in general construction; a site manager with at least level 5 construction foreman qualification specialising in general construction works; a ventilation and heating systems specialist with the relevant engineer or construction manager qualification; a water supply and sewerage systems specialist with the relevant engineer or construction manager qualification; and, for electrical works, a person with at least a class B competence certificate or level 6 electrical engineer qualification. For foreign bidders, equivalent competence is accepted. All of these persons must be involved in carrying out the works.
