Compliance requirements
The bidder must confirm that neither it nor the members of its management bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud and the other offences listed in the ESPD. If any exclusion ground applies, the bidder may provide evidence of self-cleaning measures to restore reliability. The bidder must also be able to prove payment of taxes and social security contributions, if required in the ESPD.
Qualification criteria and exclusion grounds
The machine-readable notice did not include precise qualification, suitability or compliance requirements; these must be checked in the tender documents. However, the compliance conditions require that the bid must comply with the procurement documents, conditional bids are not allowed, a joint bid must include a power of attorney from the joint bidders, and a completed Form 1 for the offered products must be submitted. Unit prices must be given as a single figure and will be fixed for the entire framework agreement period. The bidder must also confirm that the offered goods are not subject to international sanctions and that it does not use subcontractors or suppliers accounting for more than 10% of the contract value if they are Russian nationals, residents or entities established in the Russian Federation, or entities controlled by them.
