Compliance requirements
The bidder must confirm that neither it nor its management body members have been finally convicted within the last five years for participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour or other forms of human trafficking, or for any other exclusion grounds listed in the tender documents. If any exclusion ground applies, explanations and, where necessary, evidence of self-cleaning must be provided. Additional sanctions-based restrictions apply to subcontractors: the bidder may not involve subcontractors or suppliers representing more than 10% of the contract value if they are Russian citizens, residents or businesses established in the Russian Federation, entities more than 50% owned by such persons or entities, or representatives/agents acting on their instructions. The bidder must also confirm that it does not involve a subcontractor who would have to be replaced under Section 122(7) of the Public Procurement Act.
Qualification criteria and exclusion grounds
The tender documents set out clear turnover requirements for suitability and qualification. For lots 1–4, the bidder’s total turnover over the last three financial years must be at least EUR 80,000. For lots 5–6, the total turnover over the last three financial years must be at least EUR 70,000. To prove turnover, the bidder must complete the financial status information and submit supporting documents such as a copy of the tax declaration and a bank statement for the relevant period, or the annual report. The bid must be submitted in the exact structure required in the tender documents, and the bidder must confirm that the bid complies with all tender conditions. If the bid is submitted jointly, a power of attorney for the joint bidders must be attached. If an equivalent solution is offered, equivalence must be explained and, where necessary, proven. The machine-readable notice did not include any other precise qualification or compliance requirements; these must be checked in the tender documents.
