Compliance requirements

The bidder must confirm that neither it nor its management body members have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, money laundering or terrorist financing, child labour or other forms of human trafficking, or any other exclusion ground listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures, where permitted. In addition, the bidder must confirm that it will not involve subcontractors or suppliers representing more than 10% of the contract value if they are linked to the Russian Federation in the manner described in the sanctions rules. Subcontractors subject to replacement under § 122(7) of the Estonian Public Procurement Act must also not be used.

Qualification criteria and exclusion grounds

The bidder must meet the requirements set out in the ESPD and the compliance conditions. As to economic and financial standing, the bidder’s total turnover over the last three financial years must be at least EUR 80,000 for lots 1–4 and at least EUR 70,000 for lots 5–6. To prove this, the bidder must provide financial data and supporting documents such as a copy of a tax declaration, a bank statement or annual accounts. The tender must comply with all tender document requirements; conditional tenders are not allowed. If the bid is submitted as a joint tender, a power of attorney from the joint bidders must be attached. The bidder must also confirm compliance with the requirements for bid pricing, equivalence and conformity with the tender documents.
