Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in the Public Procurement Act apply, including bankruptcy, liquidation, suspended business activity, or tax, fee or social security contribution arrears under the law of the bidder’s country of establishment.
The bidder must also confirm that its average wage during the reference period was above 70% of the average wage in the relevant sector for the same period. The reference period is six calendar months ending with the penultimate calendar month before the start of the procurement procedure. For this point, the bidder must provide a Tax and Customs Board extract; a foreign bidder must provide equivalent evidence from a competent authority in its country of establishment. In a joint tender, the evidence must be submitted for each joint bidder.
The bidder must confirm that it is not a related person to the technical consultant advising the beneficiary on the reconstruction of the apartment building.
The machine-readable notice did not include any more precise exclusion grounds; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the Economic Activities Register for construction activities covering general construction, indoor climate systems, and building water supply or sewerage systems. This registration requirement does not apply to foreign bidders; in that case, equivalent proof of competence must be provided.
For electrical works, the bidder must be registered for electrical works, specifically the construction and installation of electrical installations. This registration requirement does not apply to foreign bidders; equivalent proof is accepted.
The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the expected contract value, excluding VAT. The exact amount must be entered in euros.
By submitting a tender, the bidder confirms that it can provide a performance security equal to 5% of the contract value no later than on the contract date or within 10 calendar days after contract signature. The security must remain valid throughout the construction period. A deposited sum on the beneficiary’s bank account or notary account is also accepted if the beneficiary remains the entitled party throughout the construction period. Joint bidders may satisfy this requirement together.
Within the last 60 months before the start of the procurement procedure, the bidder must have completed at least one equivalent construction project worth at least half of the expected contract value excluding VAT. An equivalent project means construction of a building, extension of a building, or full-building reconstruction as the main contractor, including at least structural and external envelope works, forced ventilation with heat recovery, and construction or reconstruction of a new heating system. The bidder must provide the project name, building details, time of performance, value excluding VAT, confirmation that it was carried out as main contractor, and evidence such as a handover certificate or a reference to the building register use notice or occupancy permit.
The bidder’s team must include a project manager with at least level 6 construction engineer qualification specialising in building construction and construction management competence, or level 6 construction manager qualification specialising in general construction. A foreign bidder may provide an equivalent competent person. The person must be involved in the works and the bidder must provide the person’s name and professional certificate number.
The bidder’s team must include a site manager with at least level 5 construction foreman qualification specialising in general construction works. A foreign bidder may provide an equivalent competent person. The person must be involved in the works and the bidder must provide the person’s name and professional certificate number.
The bidder’s team must include a ventilation and heating systems specialist with at least level 6 heating, ventilation and cooling engineer qualification with competences in managing heating system construction and ventilation system construction, or level 6 construction manager qualification specialising in indoor climate systems. A foreign bidder may provide an equivalent competent person. The person must be involved in the works and the bidder must provide the person’s name and professional certificate number.
The bidder’s team must include a water supply and sewerage systems specialist with at least level 6 water supply and sewerage engineer qualification with construction management competence, or level 6 construction manager qualification specialising in building water supply and sewerage systems. A foreign bidder may provide an equivalent competent person. The person must be involved in the works and the bidder must provide the person’s name and professional certificate number.
For electrical works, the bidder’s team must include a person with at least a class B competence certificate or level 6 electrical engineer qualification in consumer electrical installations. A foreign bidder may provide an equivalent competent person. The person must be involved in the works and the bidder must provide the person’s name and competence or professional certificate number.
The bidder must have a quality management system in the field of construction works that meets at least EVS-EN ISO 9001 or equivalent requirements, and an environmental management system that meets at least EVS-EN ISO 14001 or equivalent requirements.
