Compliance requirements
The bidder must confirm that neither it nor the members of its management, administrative or supervisory bodies, nor persons with representation powers, have been finally convicted within the last 5 years for participation in a criminal organisation, corruption, fraud and the other exclusion grounds listed in the ESPD. If any exclusion ground applies, the bidder may submit evidence of self-cleaning measures, where permitted. The machine-readable notice did not include precise exclusion grounds; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must submit the tender in accordance with the procurement documents and confirm that the offer complies with the technical specification. Required contact details must be provided: one person who will sign the framework agreement if the bid is successful, and one person who will be named as the contact person for contract performance. The tender price must be entered according to the structure in the worksheet titled 'Award criteria and evaluated indicators'. The bidder must hold a wholesale pharmaceutical distribution licence under Section 38 of the Medicines Act; the contracting authority will verify this itself. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned areas, and that it does not use subcontractors or suppliers for more than 10% of the contract value if they are Russian citizens, residents or undertakings established in the Russian Federation, entities more than 50% owned by them, or representatives of such persons/entities or persons acting on their instructions. The machine-readable notice did not include precise selection, suitability or compliance requirements; these must be checked in the tender documents.
