The bidder must confirm that neither it nor the members of its management, administrative or supervisory bodies have been finally convicted in the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences or other exclusion grounds listed in the ESPD, or that any exclusion period stated in the conviction still applies. If an exclusion ground exists, the bidder may submit self-cleaning measures if permitted. The bidder must also confirm that the supplied goods are not subject to international sanctions and do not originate from sanctioned regions. The bidder must also confirm that it will not involve subcontractors or suppliers representing more than 10% of the contract value if they are linked to the Russian Federation in the manner described in the regulation.

The bidder must be registered in the commercial register of its country of establishment, if required by the law of that country. A bidder registered abroad must provide evidence of registration upon the contracting authority’s request. The tender must comply with all requirements set out in the tender documents; conditional tenders are not allowed. In the case of a joint tender, an authorised representative must be appointed and a power of attorney from the joint bidders must be attached. The bidder must confirm that the offered equipment complies with the requirements and, where necessary, that equivalence has been explained and supporting evidence has been attached. The bidder must complete the equipment list and the price table in the required format and submit the price in euros with two decimal places. The tender is divided into lots and bids may be submitted for all four lots; a contract may be awarded to one bidder for up to four lots. The machine-readable notice did not include precise additional qualification or compliance requirements; these must be checked in the tender documents.
