Compliance requirements
The bidder must confirm the standard exclusion grounds, including that neither the bidder nor members of its management bodies have been finally convicted within the last 5 years for participation in a criminal organisation, corruption, fraud, or offences related to a terrorist act or terrorist activity. The machine-readable notice listed these grounds, but all details and any additional conditions must be checked in the tender documents. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures to restore reliability, where permitted.
Qualification criteria and exclusion grounds
The bidder must demonstrate technical and professional capacity through previous sales contracts. For each lot, the bidder must show that it has performed at least 3 sales contracts for the relevant product within the previous 36 months and provide the value, dates and other contracting parties for those contracts. The requirements apply separately to the lots: 1) A06AD11 Lactulosum, oral solution, 650–670 mg/ml 100 ml; 2) A06AD81 Natrii sulfas anhydricus + Kalii chloridum + Natrii chloridum + Macrogolum + Natrii hydrogencarbonas, powder; 3) A06AG11 Laurilsulfas + Sorbitolum + Natrii citras, rectal solution, 9 mg + 625 mg + 90 mg 5 ml. Under the compliance requirements, the bidder must confirm that the bid complies with the tender documents, submit a joint-bid power of attorney if bidding jointly, justify any trade secrets, and complete and submit Annex 2, the price quotation form. The machine-readable notice did not include any other precise qualification or compliance requirements; these must be checked in the tender documents.
