Compliance requirements
The bidder must confirm that neither it nor its management, governing or supervisory body members have been convicted in the last five years for participation in a criminal organisation, corruption, fraud or any other exclusion ground listed in the tender documents. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The notice also includes a sanctions-related condition: the bidder confirms that it will not use subcontractors or suppliers accounting for more than 10% of the contract value if they are Russian citizens, residents, entities established in the Russian Federation, or persons/entities controlled by them. The bidder must also confirm that it will not use subcontractors who are subject to replacement under Section 122(7) of the Public Procurement Act.
Qualification criteria and exclusion grounds
The bidder must be entered in the commercial register of its country of establishment, and the contracting authority may request proof of registration. To perform the service, the bidder must hold the community transport operating licence or taxi transport licence required under the Public Transport Act, as well as the taxi vehicle card, which authorise paid passenger transport in Estonia. The bidder must submit a list of at least one contract completed during the last three years showing that it has provided the subject transport service, including adapted transport, for at least 30 calendar months. The list must state the contract period, the contact details of the other contracting party, and include a confirmation signed by the client’s legal representative regarding the contract period and performance. The tender must comply with the tender documents, and equivalent solutions must be supported by relevant evidence. Drivers used for the service must have held the relevant driving licence category for at least 3 years and must have been checked against the restrictions on working with children. For service delivery, the bidder must have at least one technically sound accessible minibus with a ramp or lift for wheelchair access and a wheelchair securing device, plus two M1 category passenger cars with valid roadworthiness inspections. If the bid is a joint bid, a power of attorney for the joint bidders must be submitted, and a vehicle list form must be provided.
