Compliance requirements
The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members, nor other persons with authority to represent it, have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences or offences related to terrorist activities, money laundering or terrorist financing, or any other exclusion grounds listed in the tender documents. If any exclusion ground applies, the bidder must provide the required explanations and, where relevant, evidence of self-cleaning measures. Subcontractors are subject to separate checks during contract performance, but these do not replace the bidder’s own exclusion grounds.
Qualification criteria and exclusion grounds
The bidder must have completed at least one waste transport contract within the 36 months before the start of the procurement. The contract must have been completed during that period. The ESPD must include the contract description, value, dates, client and other required details. If the bidder relies on the capacities of another entity, the ESPD of that entity and its consent must also be submitted. The tender must comply with the procurement documents, be submitted by a person with signing authority, and, where necessary, include a power of attorney. In a joint tender, each joint bidder must submit the required confirmation. The tender price must be provided in the required structure and on the cost list form. If an equivalent solution is used, it must be explained and supported by evidence. In a joint tender, a joint power of attorney must be submitted.
