Compliance requirements
The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members, procurators or other authorised representatives have been finally convicted within the last five years for participation in a criminal organisation, corruption or any other exclusion grounds listed in the tender documents. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The tender documents also include a sanctions requirement: the bidder confirms that it will not use subcontractors or suppliers for more than 10% of the contract value who are citizens of the Russian Federation, residents of the Russian Federation, entities established in Russia, entities more than 50% owned by such persons or entities, or representatives of such persons or entities acting on their instructions. In addition, the bidder must confirm that it will not use a subcontractor that would be subject to replacement under Section 122(7) of the Public Procurement Act.
Qualification criteria and exclusion grounds
The bidder’s net turnover for the last financial year ended by the start date of the last 3 procurement procedures must be at least EUR 400,000 per year. The bidder must provide turnover data for the last three completed financial years if these are not available from the register. As to technical and professional capacity, the bidder must have performed at least one information system development or modernisation project in the last 5 years with an actual work volume of at least 5,000 working hours and using an X-Road interface, an external mail server for email delivery, TARA for user authentication, and successful OWASP testing. In addition, within the last 3 years the bidder must have completed at least one solution using an X-Road interface, an external mail server, TARA and OWASP testing. If a reference was carried out in a consortium, under a framework agreement or together with other contractors, only the bidder’s own actual work volume is counted. Exact evidence and form requirements must be checked in the tender documents.
