Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in Section 95(1)(1–5) and Section 95(4)(12) of the Estonian Public Procurement Act apply. If there are other persons in the company who may represent the bidder, make decisions on its behalf or control it and who are not visible from the commercial register card, the bidder must provide their name and personal identification code, or confirm that no such persons exist.
Qualification criteria and exclusion grounds
The bidder must have completed, within the 36 months before the publication date of the contract notice, up to 2 retail fuel sales contracts with a total value of at least EUR 1,000,000 excluding VAT. If performance continued beyond that period, only the part performed within the reference period is counted. If performance was under a framework agreement, the bidder may rely on contracts or orders concluded and performed under that framework agreement.
For Lot 1, the bidder must submit the list of contracts on Annex 6 and, where applicable, the consent of another undertaking on Annex 9. If the bidder relies on another undertaking’s capacities, the subcontractor’s details must be added and it must be confirmed that the other undertaking participates in direct performance of the contract. In a joint tender, information on the size and nature of each joint tenderer’s share must also be provided.
For Lot 2, the bidder must submit the list of contracts on Annex 7. For Lot 2, at least 1 retail fuel sales contract worth at least EUR 150,000 excluding VAT must have been completed within the last 36 months. Here too, the bidder may rely on contracts or orders concluded and performed under a framework agreement and, where necessary, on another undertaking’s capacities, provided the required consent and supporting documents are submitted.
The bidder must also provide a list of fuel stations: at least 5 stations in Tallinn and additional stations at the locations listed in Table 2 of Annex 1.1. The tender must be submitted in the required structure and, where necessary, equivalence must be explained and evidence of equivalence attached.
