Purchase of motor fuel

The bidder must not have any exclusion grounds listed in § 95(1) points 1–5 and § 95(4) point 12 of the Public Procurement Act, and a confirmation of this must be submitted in the public procurement register. If the company has other persons who are authorised to represent it, make decisions on its behalf or control it and who are not visible on the commercial register card, the bidder must provide their names and personal identification codes, or confirm that no such persons exist.

The bidder must prove technical and professional capability with completed fuel retail contracts. For part 1, up to 2 contracts completed within the last 36 months must have a total value of at least EUR 1,000,000 excluding VAT. For part 2, at least 1 contract completed within the last 36 months must have a value of at least EUR 150,000 excluding VAT. If performance took place under a framework agreement, qualification may be demonstrated through contracts or orders concluded and performed under that framework agreement. The bidder must submit the contract list form for the relevant part (Annex 6 or Annex 7), including contract values, signing dates and details of the other contracting party. If the bidder relies on another entity’s resources, an Annex 9 consent must be submitted and the subcontractor must be indicated. In the case of a joint tender, a power of attorney and information on the size and nature of each joint tenderer’s share must be provided. For part 1, the bidder must also submit the list of fuel stations and confirm compliance with the tender documents, sanctions requirements and equivalence conditions.
