Compliance requirements
The tenderer is excluded if it or its management, supervisory or representative persons have been convicted of participation in a criminal organisation, breach of integrity duties, corruption, fraud, terrorist offences or related incitement, aiding or attempt, money laundering or terrorist financing. Exclusion also applies if they have been convicted of enabling work for a foreign national staying in the country without a legal basis or of violating the conditions for employing a foreign national in Estonia, including paying less than the statutory wage rate, or of illegal use of child labour or human trafficking. The tenderer is also excluded if it has tax, fee or environmental charge arrears, or arrears of tax or social security contributions under the law of its country of establishment. The contracting authority may also exclude a tenderer for serious or persistent breach of a previous public contract, or if the tenderer has provided false information or failed to submit required information or additional documents. The notice also prohibits participation by companies established in Russia or Belarus.
Qualification criteria and exclusion grounds
Within the 60 months before the start of the procurement, the tenderer must have properly performed at least three contracts for electrical construction works similar to the subject of the contract, and at least one of them must have had a value of at least EUR 40,000 excluding VAT. The tenderer must submit a list of the contracts showing the performance period, the other contracting parties and, in public procurement cases, the reference numbers. On request, the contracting authority may require evidence that the similar electrical construction contracts were properly performed, unless it can obtain the information from public or its own databases without significant cost. In addition, the tenderer must have a person in charge of electrical works with a valid A-level competence or a qualification corresponding to at least level 6 under the Vocational Qualifications Act; a valid certificate must exist at the time of submission of the tender, and the person must be entered in the EPP environment before the opening of tenders. For switching operations in the 0.22–20 kV electricity network, the tenderer must have a worker with switching rights; if only low-voltage works of 0.22–1 kV are procured, at least low-voltage switching rights are required, otherwise both low-voltage and medium-voltage switching rights are required. The tenderer must also have a person appointed as responsible for the work operation, entered in the EPP environment before the opening of tenders. The tenderer must provide the names, job titles and contact details of the contract signatory and the contact person, and a power of attorney if the right of representation does not arise from the articles of association.
