Compliance requirements
The contracting authority will exclude a bidder if the bidder or its management, supervisory or representative persons have been convicted of offences such as participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or financing of terrorism. Exclusion also applies if the bidder or its relevant persons have been convicted for enabling illegal employment of a foreign national, violating conditions for employing a foreign national in Estonia, or illegal use of child labour or human trafficking. A bidder is also excluded if it has tax, duty or environmental charge arrears, or if awarding the contract would breach an international sanction or a Government of Estonia sanction.
The contracting authority may also exclude a bidder for serious or repeated breach of an earlier public contract, if the bidder has provided false information about the absence of exclusion grounds or compliance with qualification requirements, or if required additional documents were not submitted.

Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of an EU Member State, an EEA contracting state or a WTO GPA member state, if this is required by the laws of the bidder’s country of establishment. A bidder established in Estonia does not need to submit a copy of the registration certificate unless the contracting authority requests it.
If the bidder relies on the capacities of another undertaking, it must provide details of that entity and also submit that entity’s confirmations.
The bidder’s net turnover for each of the last three completed financial years before the start of the procurement must be at least EUR 200,000 excluding VAT. If the financial year is not the calendar year, the turnover data must be provided for the relevant financial-year periods. Evidence is submitted on HD Annex 5, and the contracting authority may request an extract from the annual accounts or other supporting documents.
Within the last 60 months, the bidder must have performed at least 2 contracts whose subject was an independent expert assessment, audit or management consultancy for large-scale IT or infrastructure development projects. Each contract must have had a value of at least EUR 50,000 excluding VAT. A large-scale project means a project with a total value of at least EUR 5,000,000 and/or a duration of at least 24 months. At least one reference must come from a rail or other transport-sector project. An ongoing contract may also be counted if the required volume has already been completed. Evidence must be provided on HD Annex 5, and the contracting authority may request a client confirmation.
