Compliance requirements
The contracting authority will exclude a bidder if the bidder, or a member of its administrative, management or supervisory body, a procurator or another person authorised to represent or control the bidder, has been convicted of participation in a criminal organisation, breach of integrity, corruption, fraud, a terrorist offence or related incitement, aiding and abetting or attempt, money laundering or terrorist financing.
Exclusion also applies if such persons have been convicted of enabling the employment of a foreign national staying in the country without legal basis or of enabling a breach of the conditions for employing a foreign national in Estonia, including payment of wages below the statutory wage rate, or of illegal use of child labour or human trafficking.
A bidder may also be excluded if it has tax, fee or environmental charge arrears, or tax or social security contribution arrears under the laws of its country of establishment, or if award of the contract would breach an international sanction or a sanction of the Government of the Republic of Estonia.
The bidder must confirm the absence of exclusion grounds on the required form. In a joint bid, all joint bidders must provide the confirmations relevant to them.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of an EU Member State, an EEA contracting state or a WTO GPA member state, if this is required by the laws of the bidder’s country of establishment. If requested by the contracting authority, a copy of a valid registration certificate must be submitted; an Estonian bidder does not need to submit it if the information is publicly available.
If the bidder relies on the capacities of another entity, it must provide details of that entity and also submit the confirmation forms for that entity.
The bidder’s net turnover for each of the last three financial years ended by the procurement start date must be at least EUR 200,000 excluding VAT in each year (2023, 2024 and 2025). If the financial year does not follow the calendar year, the data must be provided for the relevant financial years. If requested, the bidder must submit an extract from the annual accounts or other documents proving the turnover.
Within the last 60 months, the bidder must have performed at least 2 contracts whose subject was an independent expert assessment, audit or management consultancy for large-scale IT or infrastructure development projects. Each contract must have had a value of at least EUR 50,000 excluding VAT. A project is considered large-scale if the underlying reference project had a total value of at least EUR 5,000,000 and/or a duration of at least 24 months. At least one reference must come from a rail or other transport sector project. An ongoing contract is acceptable if the required volume has already been completed.
For the completed contracts, the bidder must submit the data on the required form and, upon request, a confirmation from the client that the work was carried out as required and without material breaches.
