Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members, procurators or other persons authorised to represent it have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering, child labour, human trafficking or other exclusion grounds listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The machine-readable notice did not set out all exclusion grounds in full; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
To make the bid compliant, the bidder must confirm that the bid meets the tender documents’ requirements and, where necessary, that equivalence has been explained and supporting evidence has been attached. The bid price must be submitted on Form 1, Part I of the bid price form, and all required fields must be completed. If a joint bid is submitted, a power of attorney for the joint bidders must be attached. The bidder must also confirm that the bid does not contain trade secrets in a way that conflicts with the tender documents’ rules. For lots 1 and 2, the bidder must confirm that it will not involve subcontractors or suppliers performing more than 10% of the contract value who are citizens, residents or entities established in the Russian Federation, or persons or entities owned by or acting on behalf of such persons or entities. The machine-readable notice did not include precise qualification or suitability criteria; these must be checked in the tender documents.
