The bidder must confirm that neither it nor the members of its administrative, management or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud and the other offences listed in the ESPD. If any exclusion ground applies, the bidder may submit evidence of self-cleaning measures, where permitted. The bidder must also confirm information on the payment of taxes and social security contributions and, where necessary, provide electronic evidence or references to it. The exact exclusion grounds and declarations must be checked in the ESPD and the tender documents.

The tender must comply with all conditions set out in the procurement documents and their annexes, and conditional tenders are not allowed. The bidder must submit the completed application for participation in the procurement procedure, the technical specification tender form, the list of devices and accessories, the technical documentation, and the manufacturer’s confirmation that the bidder is an official representative and/or official distributor. The tender price must be submitted in the required price form and in the prescribed structure. The bidder’s team must include at least two medical technology specialists with at least 3 years of experience in servicing and repairing equipment and with manufacturer training for servicing and repairing the offered equipment. The bidder must also provide the specialists’ details and the manufacturer’s confirmation of the training or readiness to train the bidder’s medical technology specialist(s). In addition, the bidder must confirm that the tender complies with the requirements and that equivalence has been explained where necessary and supporting evidence attached. If the tender is submitted as a joint tender, a power of attorney for the joint bidders must be attached. If subcontractors or suppliers are used, the EU Council sanctions requirement must also be taken into account.
